EU data-protection opinion on CSA regulation
This is the EDPB and EDPS joint opinion on the European Commission’s 2022 CSA-regulation proposal. It recognizes child sexual abuse as an exceptionally serious problem while warning that restrictions on private life and data protection must remain necessary, proportionate, and compatible with fundamental rights.
The opinion is not the current law and it does not decide the final outcome of procedure 2022/0155. It is durable evidence that the proposal’s privacy implications have been challenged by the Union’s own data-protection institutions.
EU private communications law uses the opinion to separate a legitimate child-protection objective from a claim that any surveillance mechanism is automatically lawful or technically sound.
