EncroChat was an encrypted communications platform that sold modified smartphones — with a hardened dual-operating-system Android installation, cameras, microphones, GPS, and USB ports physically removed, and anonymous SIM cards — marketed primarily to users who wanted their communications inaccessible to law enforcement. At its peak in early 2020, it served roughly 60,000 users worldwide, including about 10,000 in Britain.

The 2020 infiltration and shutdown

French authorities began investigating EncroChat phones in 2017 after devices turned up in criminal investigations. Working with Dutch police and supported by Europol and Eurojust, they penetrated the company’s servers in northern France and deployed a technical device that bypassed the encryption, giving them access to users’ correspondence in real time.1 The joint investigation, named Operation Emma by Europol, ultimately intercepted more than 100 million encrypted messages.2

On 13 June 2020, EncroChat pushed an alert to all its users warning that authorities had seized its internet domain and launched a malware attack to gain additional access to phones, and advising users to dispose of their devices. The platform was shut down shortly afterward.

The intercepted material led to hundreds of arrests in the Netherlands, the United Kingdom, Sweden, Norway, and other European countries, mostly for drug trafficking and organized crime.1

Evidence status in Sweden

Swedish courts admit EncroChat material under the principle of free evaluation of evidence. The Swedish Supreme Court (HD) declined to review the admissibility question in 2021, leaving the uniform lower-court practice in place.

The French interception method is protected by French defence secrecy. No Swedish institution has examined the collection method, its error rate, or the completeness and selection of the messages admitted as evidence. Significance for the wiki

EncroChat is the largest deployed example in the Swedish cluster of evidence whose collection method cannot be examined by the defence or the court. It supplies the factual predicate for the claim in Rättssäkerhet in Swedish criminal cases that some Swedish prosecutions rest on conviction-grade evidence whose provenance sits outside the adversarial process.

The same structural problem recurs domestically in Mobile-device extraction and evidentiary selection, where extraction software filters and selects evidence without the defence being able to inspect the filter.
